Donahue: I do not believe this evidence is competent. Morton is qualified as an expert, but what he’s doing now, he’s not giving us any opinion whatsoever. That is not the testimony of an expert. Mr. Morton is saying, “in these particular exhibits we really don’t have anything that we can say yes or no—it is or it isn’t. We’re just saying, well, we have something favorable in general.”

Judge Bradley: Well, that goes to weight.

Again, Judge Bradley could not have been more wrong. He knew that the jurors would incorrectly believe that Morton was giving scientific testimony, and they would give irrelevant information the same weight as real evidence. This didn’t even rise to the level of junk science. Worse yet, it was a known lie, couched as a “possibility.” Because Morton knew that it wasn’t really a match, it may even have risen to the level of perjury. He was fully aware that he and DA Powell were trying to trick the jury into believing something that wasn’t true.
